Terms and Conditions for Lonestar-Academy Mobile Baseball & Softball

Effective Date: February 11, 2025

Welcome to Lonestar-Academy Mobile Baseball & Softball ("Company," "we," "us," "our"). These Terms and Conditions ("Terms") govern the relationship between Lonestar-Academy and our clients ("Client," "you," "your") and the participants in our training sessions ("Participant").

By booking, scheduling, or participating in any training session, clinic, or service offered by us, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Services

Lonestar-Academy provides mobile, on-location baseball and softball instruction. Services include, but are not limited to, private one-on-one lessons, small group clinics, and team coaching. All services are provided at a location mutually agreed upon by the Company and the Client (e.g., a public park, batting cage, or the Client's private residence).

2. Client & Participant Responsibilities

  • Location: The Client is responsible for securing or informing us of a location and providing a safe, suitable, and authorized location for the training session. The location must have adequate space and be free from hazards. Lonestar-Academy reserves the right to cancel or reschedule a session if the chosen location is deemed unsafe or inappropriate, at our sole discretion.
  • Health & Fitness: The Client must ensure the Participant is in good physical health and medically cleared to participate in strenuous athletic baseball or softball activities. The Client agrees to disclose any pre-existing medical conditions, injuries, or allergies to the coach before the start of any session.
  • Equipment: Participants are required to bring their own personal equipment, including but not limited to: a properly fitted glove, bat, helmet, cleats, and any necessary protective gear (e.g., athletic cup, face mask). Participants must also bring their own water or sports drinks for hydration. We will provide the equipment necessary for the session(s).

3. Scheduling, Cancellation, and Rescheduling

  • Booking: Sessions must be scheduled in advance through our official booking channels (e.g., phone, email, online portal).
  • Client Cancellation: We require a minimum of 24 hours' notice for any session cancellation or rescheduling.
    • Cancellations made with more than 24 hours' notice will be rescheduled at no additional cost.
    • Cancellations made with less than 24 hours' notice will result in the forfeiture of the full session fee. No refund or credit will be issued.
  • Coach Cancellation: In the rare event that Lonestar-Academy must cancel a session, we will provide as much notice as possible and will reschedule the session at a mutually convenient time. No fee will be charged for a session canceled by us.
  • Weather Policy: As a mobile service, we are subject to weather conditions. The coach will make the final decision regarding cancellations due to inclement weather (e.g., rain, lightning, extreme heat). If a session is canceled due to weather, it will be rescheduled without penalty to the Client. This decision will be made with the Participant's safety as the highest priority.

4. Fees and Payment

  • Rates: Our current rates for services will be provided at the time of inquiry or booking. Rates are subject to change, but confirmed bookings will be honored at the price quoted at the time of booking.
  • Payment: Payment is due in full before the commencement of each training session or package, unless otherwise arranged in writing. We accept payments via Cash App or Cash. Other payment methods will incur a % fee.  Therefore, we choose to avoid charging you for additional fees.
  • Late Fees: For any invoiced services, a late fee of 20% may be applied to payments not received by the due date up to 7 days after the session(s). After 7 days, an additional 20% may be charged.
  • Refunds: All sales are final. No refunds will be issued for completed sessions or for sessions canceled late or for no-shows.

5. Assumption of Risk and Liability Waiver

Participation in baseball and softball activities involves inherent risks of serious injury, including but not limited to sprains, fractures, concussions, permanent disability, and even death.

By agreeing to these Terms, the Client, on behalf of themselves and the Participant, knowingly and voluntarily:

  • Acknowledges and accepts these inherent risks.
  • Assumes full responsibility for any injuries or damages that may occur as a result of participation in Lonestar-Academy training sessions.
  • Agrees to release, waive, and hold harmless Lonestar-Academy Mobile Baseball & Softball, its owners, coaches, employees, and agents from any claims, demands, liabilities, rights, or causes of action of whatsoever kind or nature that may arise from or in connection with any injury, property damage, or loss sustained by the Participant during or related to any training activity.

6. Code of Conduct

We are committed to a positive and respectful training environment. All Clients and Participants are expected to:

  • Demonstrate good sportsmanship and a positive attitude.
  • Treat coaches, other participants, and property with respect.
  • Refrain from using foul language, abusive behavior, or engaging in any form of bullying.

Lonestar-Academy Mobile Baseball & Softball reserves the right to end a session immediately, without refund, and to refuse future services if a Client or Participant fails to adhere to this Code of Conduct.

7. Photographic and Video Release

We may take photographs or videos during training sessions for use in promotional materials, including our website, social media platforms, and print advertising. By participating in our services, you grant us the irrevocable right to use the participant's image, likeness, and voice without compensation.


If you do not want the participant photographed or recorded, please notify us in writing before the first session begins.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Smith County, Texas.

9. Acknowledgment and Acceptance

By scheduling and paying for any service with Lonestar-Academy Mobile Baseball & Softball, you certify that you are the parent or legal guardian of the Participant (if the Participant is a minor) and that you have read, fully understand, and agree to all the terms, conditions, and waivers outlined in this document.
